14. Specific Conditions for the Provision of Services
The following clauses apply specifically to the contracting of any type of service offered by EXPERT3D SL (including, but not limited to: additive manufacturing/3D printing, design, modelling, training, consultancy, or 3D scanning).
14.1. Nature of the Service and Finishes
The customer acknowledges and accepts that 3D printing technology (FDM, SLA, SLS, SLM, etc.) has inherent characteristics, such as visible layer lines, small surface imperfections, or support marks. Unless a post-processing service is expressly contracted, parts will be delivered with the standard finish of the selected technology. Standard dimensional tolerances are ±0.2mm to ±0.5mm depending on the material and geometry.
14.2. Exception to the Right of Withdrawal
In accordance with Article 103, paragraph c) of the General Law for the Defence of Consumers and Users, the right of withdrawal shall NOT be applicable to 3D printing services, as these involve goods made to the consumer's specifications and are clearly personalised. Once the production process has begun, no cancellations or returns will be accepted, except for technical defects attributable to EXPERT3D SL.
14.3. Intellectual Property and Responsibility
The customer guarantees that they hold the intellectual property rights or necessary licences for the 3D files (STL, OBJ, etc.) sent for printing.
EXPERT3D SL limits itself to performing the printing service and assumes no responsibility for the infringement of copyrights, patents, or trademarks of third parties contained in the customer's files.
Furthermore, EXPERT3D SL reserves the right to reject any order that, in its judgment, may infringe the law, be offensive, or consist of firearms or functional parts thereof.
14.4. Custody and Deletion of Files
EXPERT3D SL guarantees the confidentiality of the files provided by the customer.
Unless instructed otherwise by the customer, EXPERT3D SL will retain digital files (3D models, scans, G-codes) for a maximum period of 6 months from the delivery of the order, for the sole purpose of facilitating potential repeat orders or modifications. After this period, the files will be permanently deleted from our systems for security and privacy reasons.
14.5. Intellectual Property of Works Performed (Design and Scanning)
In the case of 3D design, modelling, or reverse engineering services contracted from EXPERT3D SL:
- Ownership: Unless expressly agreed otherwise, the economic exploitation rights over the resulting 3D models and files shall be transferred exclusively to the Customer once they have paid 100% of the agreed price.
- Reservation of Rights: EXPERT3D SL reserves the right to use images (renders or photographs) of the works performed solely for promotional purposes in its portfolio or website, unless the Customer expressly requests the signing of a Non-Disclosure Agreement (NDA) or states their opposition in writing.
